1. Agreement

These Terms apply to purchases made through the Bespoke Moment website, approved payment links and authorised sales channels.

By placing an order, you agree to these Terms and the policies incorporated by reference.

3. Eligibility

You must be legally capable of entering into a binding contract and authorised to use the selected payment method.

4. Product Categories

Bespoke Moment sells:

Gift Jewellery;
Custom Jewellery.

Different cancellation and change-of-mind conditions apply.

5. Product Information

We take reasonable care to describe jewellery accurately.

Measurements, weights and colours may be approximate unless expressly confirmed.

6. Pricing

Prices are displayed in Australian dollars unless otherwise stated.

The checkout or personalised quotation will identify the amount payable.

7. Errors

Where a genuine pricing or description error occurs, we may contact you before fulfilment to:

confirm the corrected details;
offer a suitable alternative;
cancel and refund the affected order.

8. Payment

Payment must be completed through an approved payment method.

Custom orders require a 70% deposit and 30% final balance unless otherwise agreed in writing.

9. Fraud and Verification

We may request reasonable information to verify identity, payment authority or delivery details before processing a high-value order.

10. Custom Orders

Custom orders are governed by the Custom Jewellery Policy.

11. Shipping

Shipping is governed by the Shipping Policy.

12. Returns

Returns and remedies are governed by the Refund & Returns Policy and Australian Consumer Law.

13. Intellectual Property

Website content, branding, photographs, original designs and written materials belong to Bespoke Moment or are used with permission.

They may not be reproduced for commercial use without written consent.

14. Customer-Supplied References

Customers confirm they are entitled to share reference images with us.

Reference images do not create a guarantee of an exact copy.

15. Website Use

You must not:

misuse the website;
attempt unauthorised access;
introduce harmful code;
use the website for unlawful activity;
copy content for commercial exploitation.

16. Consumer Guarantees

Nothing in these Terms excludes, restricts or modifies rights that cannot lawfully be excluded.

17. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect loss that was not reasonably foreseeable.

This clause does not limit liability or remedies that cannot legally be excluded, including applicable Australian Consumer Law rights.

18. Events Outside Reasonable Control

We are not responsible for delay caused by events outside our reasonable control, but we will provide updates and an appropriate solution where required.

19. Governing Law

These Terms are governed by the laws of Australia, subject to any mandatory consumer protections that apply to Australian customers.

Because you actively offer products to Australia, ACL coverage may apply to Australian consumers even though your operating company is overseas; the ACCC distinguishes overseas businesses that directly offer products in Australia from those that do not.
